If Mahathir study "Law of Contract" - he probably will not challenge us in Court.

The 4 elements of "Law of Contract" :-
(1) Offer
(2) Acceptance
(3) Consideration
(4) Mutual Agreement of legal consequences

--- non of them are fulfilled by Mahathir and his gang. (No offer from us, no acceptance from us, no Consideration perform by Malaysia group with monetary benefits, no legal documents signed - to the effect of revision of water prices).


Malaysia stand now is in effect "an invitation to treat" to revise price - in which we will not accept it - and thus the element of "Offer" does not materialise - and the subsequent elements of "Acceptance", "Considerations" and "Legal intention" --- will not take place - and thus Malaysia has no legal ground in the price revision.

Conversely, we have all the above 4 elements.
(1) Offer - to revise price in 1987 or status quo

(2) Acceptance - Mahathir want status quo in 1987, in Jan 2018, Najib sign reaffirmation

(3) Consideration -
(a) we build the Linggiu Dam at $300 million after 1987 to reinforce the water agreement.
(b) We supply 16 mgd a day to Johor as goodwill (above the 5 mgd a day - legal requirement).
(c) Singapore has so far spent more than S$1 billion on water projects in Johor.

These are committed based on the considerations that there will be no further revision in the water prices.

(4) Mutual Agreement of legal consequences -
(a) (i) in 1962 Water Agreement and in 1965, when Singapore was ejected from the Federation of Malaysia, Singapore took the precaution of ensuring that the 1962 Water Agreement was guaranteed by the governments of both Malaysia and Singapore.
(ii) It forms in effect part of Singapore and Malaysia 1965 Separation Agreement.
Any breach of the 1962 Water Agreement would call into question the Separation Agreement, and this Separation Agreement is the basis of our existence of an independent sovereign state.
Therefore, Malaysia and Singapore must fully honour the terms of the 1962 Water Agreement, including the price of water stipulated in it,
Neither Malaysia nor Singapore can unilaterally change the terms of this agreement between the two countries.

(b) 1987 agreement not to revise water price - signed by PM of both Countries
(c) Jan 2018 reaffirmation of terms and conditions of the Water Agreement (including the water prices) - signed by PM of both Countries

--- All the above are legally binding document that are signed.

Based on the above legal ground, Malaysia has lost right to review the price of water.

That is why our legal ground are very strong ---- good thing they fall into our wish to go to Court.

Singapore should put this water issue with Malaysia to rest once and for all to avoid their constant use of this issue to put us edge. And the only way to deal with them is to use the international arbitration court to come to conclusion.

Let me tell Dr Mahathir and media director of Bersatu’s Johor chapter Mohd Solihan Badri about your standard of Morality:

What is "Morally Wrong": Malaysia sells the water to Malaysia consumers = RM$3.60 sen (per 1000 gallons) but buy from Singapore at RM$0.50 sen (per 1000 gallons). You ripped off Johoreans RM3.10 per thousand gallons!

What is "Morally Wrong": You complaint that RM 3 cents per thousand gallon is too cheap now, yet in 1987 when you can review the price, you choose not to because you know the TREATED water you get from Singapore then was "DIRT" cheap, YET you never complained to Johoreans that those DIRT CHEAP water was MORALLY WRONG to get from Singapore

What is "Morally Wrong": Singapore invested over a Billion Singapore dollars in your Linggiu dam, all paid by Singapore citizens. Malaysia need not have to pay ONE CENT! Singapore will return the whole Damn Dam to you in good condition by 2061. Yet, You stoke anger with Malaysians on 3 cents but covered up the over 3 Billions Ringgit Malaysia will received in 2061!

What is "Morally Wrong": Singapore supplied extra treated water to Johore way above the water agreement to help Johoreans whenever there are problems with water supply. This is in the spirit of goodwill and good-neighbourliness and Singapore does not expect anything in return BUT Singapore does not deserved being called a “profiteer” or skimming poor neighbour! What Moral Principle is Mahathir and his cronies based on?

What is "Morally Wrong": This 1962 water agreement is part of Singapore Independence agreement. You tear this water agreement will open up other agreements which jeopardise Singapore as a sovereign nation. What stop you from complaining later that the “divorce” in 1965 was unfair because Malaysia did not ask for compensation just like EU requires UK for Brexit “divorce bill”! So, if Singapore agrees to adjust the water price, Singapore should also pay “Divorce Bill” too, right?

Yeok Fong Yong He will hide this half of the story to his gullible ignorant people and they believe him whole sale the 3 sen story and he also know full well the rain water fall from the sky FOC. So the 3 sen is money for nothing.
On top of this he is also "profiteering" from the Johoreans by selling them treated water from Singapore. And by 2061 the 3 Billons RM will be much more than today's price. Too bad he won't be around to see it. What he blabbers and does is not only Morally Wrong but EVIL.

We are waiting for this Old Dog to pay cost on water arbitration issue cos most people who understand English will know that the agreement is in Singapore's right more so in our favour. The Old Dog is going to waste malaysia tax payer money with us on arbitration. Most of his ministers have fake degree and that leds to them unable to comprehend simple text in the agreement.

The truth is Mahathir also doesn't know how much he want for 1000gallon of untreated water. He just wants to muddy the water. He asked for 45 sen per thousand gallons in August 2000, to 60 sen in February 2001, to RM6.25 in September 2002. Now he is asking for 1000% increase which is a mere 30 sen at an exchange rate of MYR3 to SGD1.

Dr M must have figured out another way to resolve their financial burden after the 1MDB saga, at RM 3 or may be RM 5 a litre that he can squeeze out from Singapore in the water issue would go a long way to lighten that financial burden that Malaysia is currently carrying. 1 trillion RM burden as per his FM earlier report. Just a thought take this thought with a pinch of salt. But anything about Dr M one will never know.

Correction should be RM 3 or RM 5 per 1000 gallon. If at RM 3 per thousand gallon Singapore has to pay Malaysia 250,000 (per thousand) X RM 3 = RM 750,000 per day taking for granted Singapore draw up to 250 millions gallon each day as per agreement. Hope my maths is correct. If every month we draw the water to the maximum that will be RM 750,000 X 30 days = RM 22.5 millions a month. See how the figure making sense to Malaysia to take up the water agreement.

Singapore should build hugh water retention tanks underground at various strategic location around the island. Divert all drains to those underground tanks to collect and store rain water.

Malaysia lost its right to review the water agreement with Singapore after Mahathir as PM-4 forget to review in 1987 (the only chance) hence the price will be the same till 2061. Singapore made many investment decisions in Johor base on the same water price and Malaysia benefitted from Singapore selling subsidized treated water too. But now Mahathir want to make noise just for political purposes is NOT right and ethical. Singapore will have a much bilateral ties with Malaysia if it was Najib Razak's BN administration which has initiated RTS, High speed rail to KL and even one checkpoint clearance for both countries. But now all is gone thanks to Mahathir and DAP trying to bully Singapore hence their country economy is going bad to worse.
