Low Taek Jho, also known as Jho Low, bought the Bombardier Global 5000 jet for US$35.4 million in 2010 using funds allegedly taken from 1MDB, the US Department of Justice (DOJ) has said.
Malaysia is seeking to repossess the jet which, according to some media reports, was grounded last year in Singapore.
Jet Aviation said on Monday a Bombardier Global 5000 with the same registration number as the one identified by DOJ was at its facility at Seletar Airport in Singapore.
--
US DOJ say that Jho Low use 1MDB fund to buy the private jet.

Now Aviation services firm Jet Aviation said a Bombardier Global 5000 with the same registration number as the one identified by DOJ was at its facility at Seletar Airport in Singapore.

A spokeswoman for Jet Aviation said the firm was "working closely with the local authorities". She declined to say how the firm came to be in possession of the aircraft.

So now things get very complicated as Jet Aviation seems to have taken possession of the private jet.

Wonder how Dr M claim "Nemo dat" to re-possess of the private jet - without going through a legal process.

Can just kawan kawan cause Singapore to release the private jet to Malaysia custody without going through the due diligence of the legal process?

Obviously not.

Singapore must become a good neighbour to Malaysia irregardless of how horrible we were treated by people from across the causeway. We are a country that is just and honored and we have professionals and good legal advisors that will ensure due processes are carried out to assist Malaysia in the recovery of whatever that rightfully belong to them.
We must take this opportunity to strengthen our rapport with their new government and build lasting friendship. Bygone is bygone, we should never miss out this good opportunity to seal a lasting relationship with our neighbour.

Singapore's foreign policy is :-
"Be friends with all,
Be adversaries with none."

Singapore will try to work out mutual benefits with our neighbors or other Countries to ensure good relationship are forged.

But this must be done in accordance with "rule of law".

Else all international order or domestic order will break apart.

Just see what Trump has done to International order - when he does not observe the rule of law - international order has become chaotic.

We are not saying that we are not going to help Malaysia acquire the private jet - but must do so in order not to contravene domestic law and international law.

Else someone will later sue us for not observing law - if we did not do so legally.

Now this Aviation firm seems to have taken possession of the private jet - not Jho Low.
Problem arise now whether the legal owner is Aviation firm or Jho Low.

If Dr M claim based on the ground of "Nemo dat" against Jho Low - and the Court discover that in fact the Aviation firm possess the legal title of the private jet - and we have release the private jet to Malaysia --- who will be legally liable?

Singapore or Malaysia?

We will be in trouble not Malaysia.

It will end up that Singapore will have to compensate the Aviation for the jet price while Malaysia happily take into custody of the plane.

We end up the biggest loser.

We must help Malaysia to acquire the private jet legally and properly.
But we must not expose ourselves to legal suit - for not complying with "rule of law".

Else we end up :-
(1) Compensating the Aviation firm for the price of the jet.
(2) Damage our reputation as the regional legal centre - for messing up this case.

We ended up a "big sucker" - when it is suppose to be "none of our business".

Ricky Lim There is no such thing as friends to all, adversary to none. You want to be friend but others don't want to friend you. You don't find trouble but trouble come to you.
As said, Singapore government has the best legal mind onboard. Our law minister was a top lawyer that is very competent in giving our government advice so please stay chilled.
If DOJ in America has given clearance, no contest from Jho Low who is nothing but a fugitive from justice now, he can only eat dust if he wants to contest the state.

John Low - "There is no such thing as friends to all, adversary to none. You want to be friend but others don't want to friend you. You don't find trouble but trouble come to you."

With regard to your above statement, I beg to differ.

Singapore has virtually no adversaries in this World. Forging mutual benefits are possible.
Singapore can achieve this foreign affair priniciples.

As for legal recourse in handling the private jet --- I am very confident about our legal people. In fact it is least of my worry.

Most of my message is not for Singaporeans --- but meant for Malaysians in social media.

Malaysians will discover a cultural shock - on the ways we handle things - as we handle things professionally, legally and appropriately.

Conversely, throughout the correspondence I observe in the social media --- Malaysians culture is exactly the opposite - where kawan kawan, negotiate negotiate, bend the law, under table deals etc seems to be their innate culture.

Telling them the right ways to conduct business and observe rule of law --- will be a long way - to put them in the right track.

Else we will face alot of problem - when we have joint projects with them.

Look at the way they talk about HSR, water, acquiring this private jet, also seeing how they casually take over the yacht, cancelling sign projects with China etc ---- reveal their innate culture.

Also people to people dealings - eg. taxi drivers will turn off the meter and instead negotiate taxi fare, some retail stores don't display the prices of their goods but want you to bargain, people can slip money when caught for traffic offenses, plus many other "dubious" practices.

The only way to educate them the proper way to conduct business --- is through social media and "people pressure".

Singapore set very high standard on professionalism - as we deal with Countries all over the World.

Eg. we do eco-city with China.
industrial park with Indonesia.
industrial park with Vietnam.
projects in India.
projects in Africa.
projects in some Middle East Countries
Business dealings and joint military training in Australia, Thailand, US, France etc.
handling US and N Korea nuclear talk.
chairmanship for ASEAN and coordinator with China.
Shangrila Security dialogue etc.

They way we conduct business and dealings with all these Countries --- is based on the way we conduct and carry out ourselves professionally.
This is how we earned our reputation that we are competent trustworthy, reliable and honest.

We must continue to upheld this - even when we deal with Malaysia --- and not let unprofessionalism creeps in and damage our reputation.

We indeed need to go through the proper legal processes and to hand over this private jet to Bolihland if it is proven beyong doubt that it was bought illegally with 1MDB money and that the US DOJ acceded to such legal arrangement.
Otherwise, the double headed roti prota can one day point his finger at SG that we are also willing to do business not according to rule of law and would try to bulldoze the Water Treaty to unilaterally increase the price per his wish.

Goh Jon Hin - I don't think Singapore deliberately hold back the private jet unnecessarily.
Because to us, the longer we hold, the greater is our cost.
(1) Storage cost in keeping the plane - where we can free it up and lease to other planes.
(2) Why do we want to unnecessary cause friction with Malaysia - if we can release the jet early?

If you notice:-
(1) We are the 1st to pull a legal team to Malaysia the moment this new Government is elected - to sort assistance for information - few days before the new Government is formed.
We are eager to help and close the 1MDB scandal ASAP - so that we can move on.

(2) Singapore is the first Country that have successfully prosecute those involve in 1MDB scandals. Few individuals have been charged in Singapore Courts, some banks have been fine and one bank have been order to close and license rescinded.

I think if we able to get all the necessary information, the necessary documents and necessary legal process in order --- we should be able to release the jet to Malaysia.
We could have been hamper by the lack of necessary documents or legal procedures, or Jho Low cannot be extradited etc.

I have no privy to what cause the delay. But I think if everything are in order, there is no reason why we are not releasing the jet.

As for the price of water, Dr M cannot unilaterally increase the price as he like - because it will boomerang them back - as Johor also need treated water from us. Also they are bounded by the agreement - it will impact them politically and legally.

Singapore knew from day one, illegal money is passing through our banking system but did not stop it. It is only right that Singapore help Malaysia get back the money/property the people rightly owns (stolen property). No need to play dirty or hold someone ransom (like asking for new water agreement etc).

If you have information about illegal money or money laundering, you should report it to the relevant Authorities.

Money laundering or illegal money contravene both our domestic law and international law - and Singapore will definitely investigate if you have information.

We are a financial hub that handle offshore lending and borrowing more than $1 trillion every year.
And we are eager to protect our reputation as a legal financial hub - and will definitely clam down on illegal money and money laundering.

Monetary Authority of Singapore (MAS)

Anti-Money Laundering / Countering the Financing of Terrorism
Financial institutions operating in Singapore are required to put in place robust controls to detect and deter the flow of illicit funds through Singapore's financial system. Such controls include the need for financial institutions to identify and know their customers (including beneficial owners), to conduct regular account reviews, and to monitor and report any suspicious transaction. The requirements on financial institutions are set out in MAS’ Notices on the Prevention of Money Laundering and Countering the Financing of Terrorism (AML/CFT Notices).

Financial institutions should also refer to Guidance Papers for good practices for combating money laundering and terrorism financing, and AML/CFT Announcements for information on high risk jurisdictions as well as other news.

Under the MAS Act, a financial institution that fails or refuses to comply with the requirements of its applicable AML/CFT Notice is guilty of an offence and will be liable on conviction to a fine not exceeding $1 million.

It's not a matter of earlier or later, but go through the legal process. Why jump the gun?
We are always their friends but that friendship must be a two-way tie and mutually respected one.
At this moment, Double Headed Roti Prata (DHRP) is trying all means to unilaterally increase the raw water price but mentioned nothing on price increase on treated water flowing in the opposite direction.
DHRP can turn and flip anyhow anytime. Why give him the opportunity to accuse us if we compromised by doing them a favour and not following the rule of law?

Ricky Lim Friends don't do this to us: Invite other PM to Belt and Road and leave out our most important man. They also don't hold up your newly acquired state of the art military weapon for days, take a peep and return you. They also don't go to the media to cancel a big HSR project then officially still under consideration. Threaten you with new water pricing revision.
Nevermind the difficult landscape, our more professional government will not be distracted by the fancy showboating of some of these distraction. We remain committed to be a friendly nation to others.

John Low - Conducting diplomacy will have its up and down.
Just like friends and even family members.
There will be quarrel and there will be good times.

We need to have maturity how we handle diplomatic affairs - just like any human relationship.

We need to forge friendship and look to forge mutual benefits - and cannot to continue to look for differences and widen the gulf.
Else we will have more adversaries then friends --- and we will have problem in promoting trade, business, investment and travel. We will also have smaller political space in the international arena.

To date, Singapore has virtually no adversaries - but more and more business partners and in political spaces we have alot of friends.

With China, we have the most business and projects, investments and trade - despite the hiccups in detaining our military assets for a while.
Annually, our DPM and China Vice President held high level Ministerial meetings to strategise business opportunity and workplan to ensure both Singapore and China embark on for mutual benefits.
Singapore is the only Country that have business and projects in virtually all the major provinces in China. This is the extent of how China has trust us - in the development of China.
In Belt and Road Initiatives, Singapore is the only major partner with China in helping to develop Chongqing - the nexus of connectivity of Belt and Road. Singapore is also the major financial partners to help to get foreign investors and business on board into the Belt and Road.
China confer Singapore as the Country-of-Honour.
Our relationship with China is at its peak.

With Malaysia, who is part of ASEAN, there are many common interests that we have embark on with them and Malaysia is also one of our major trading partner - though there are some pain points.

On course when we get bullied - we will need to stand for our own rights and not let be run over. Else we will lose our Sovereignty and we will get bullied now and then. This is the same when we conduct relationship with others - whether friends or relatives or even our loved ones.

It is how we re-emerged and re-cement our relationship after some hiccups in the relationship.

By putting up front the above statement ---- it represent Singapore's foreign affair principle in conducting our diplomatic relationship with all Countries in the World.

There will be up and down in the relationship.

But the statement - will serve as reminder to come back to our priniciple in conducting our diplomatic relationship with the World ---- that has given Singapore and the World - Peace, Harmony, Cooperation and Prosperity.
