Ministry of Manpower (MOM) said on Monday, 14 August, that it is seeking public views on designating platform workers as a distinct category of workers, noting that creating a category distinct from other employees and the self-employed would make it easier for these workers to understand the legal protections and support schemes that they are eligible for.

MOM also said platform operators need to take “reasonably practicable measures” to ensure the safety and health of platform workers with whom they enter into contracts, and it wants to get feedback on these obligations.

💬 *What are your views on MOM’s proposal to designate platform workers as a new, distinct category of workers? How can we better protect platform workers through the various support schemes?*

Deliverymen and ride-hailing drivers who use online matching platforms such as Grab, foodpanda and Lalamove for work here could be designated as a new worker category under new measures that are being drafted by the authorities.

These measures include setting reasonable expectations for how much time is needed to fulfil a job so that workers do not need to rush, and rolling out mechanisms for the public to report unsafe driving or riding to the respective platform operators. These new measures are expected to kick in from the second half of 2024.

The new protections will be given only to platform workers who provide ride-hailing and delivery services.

📌 *Defining Platform Operators*

MOM proposes that platform operators here be defined by 3 ‘prongs’:

1️⃣ The first prong defines platform operators as those that collect data to automate the matching of customers with workers – for instance, by assigning a particular ride-hailing driver to make a trip based on his estimated time of arrival.

2️⃣ The second prong limits the scope to cover only operators that provide such chargeable matching services as a business model.

3️⃣ The third prong further defines platform operators as those that exert control over platform workers, by limiting their ability to choose their hours of work or negotiate a fee, for example.

📌 *MOM Public Consultation via REACH website*

The public consultation, which is being conducted online until Sept 4, will also gather views on how else platform operators and workers should be defined under the new laws, and who should be responsible for protecting platform workers engaged as subcontractors. Those who wish to give their views on these issues can do so on the REACH website at https://go.gov.sg/publicconsultpwbill by 6pm on Sept 4. 

The consultation exercise comes as the Government prepares to table new legislation in Parliament to implement a set of new policies that will grant platform workers employee-like levels of work injury compensation insurance and Central Provident Fund contributions.

Industrialisation, modernisation and globalisation are instances of accelerated performances of the world then and now. 

In 1842, the British gained concession of Shanghai port for it's trades into China, together with the French, territorial leases were given to the two capitalist nations to operate their trades in five seaports with their imposed laws. 

The Bund of Asia (Waitan) flourished for almost a century; from 1845 to July 30th of 1943 after China victory in the war against the Japanese; the Republic of China reclaimed back the ports and leases from the British, the French and the American who shared the promenade of Nanjing Street with the British.

De coupling, de risking and distrusting are happening now and then and will all these negatives become the future of many pitfalls like a big domino effect?

The last century history of the Republic of China (ROC) began with the Qing dynasty cede Taiwan then an agrarian state to the Japanese from 1895 to 1945 at the end of WW2 and the surrendered Japanese army.

The kuomintang has it fair share of it's history from Sun Yit-Sen in 1912 to the hands of Chiang Kai-shek who eventually retreated from Chongqing to Taiwan. Prior to 1938, Chiang's ambitious plan was to relocate to Hong Kong with the promised by the Americans to persuade the British to allow the KMT to occupy Hong Kong. But it was not to happen and the British denied Chiang's wish thus the alternative came, it was Taiwan. 

Today, Taiwan is the world's foremost electronics centre for the manufacturings of advanced microchips.

The reciprocity of the two, Hong Kong and Singapore, the unequal geography and different historical perspectives; today, one fixate and the other vary. 

To begin to understand why Hong Kong is fixate, we have to start from the beginning of 1842 cede of HK to the British, the exchange of the HK dollars to the US dollars was established in 1983, and the eventful liberation to China in 1997. 

Likewise, Singapore gained independence in 1965 after 98 years under the British History of Straits Settlements and the Crown colony (1819/1867); three decades ahead of Hong Kong SAR which arguably brought about many successive developmental economics plans of growth and sound socioeconomic policies that quantum leap the island state to a first world country and at the other end is the geography and politics of the Pearl of the Orient that spelled success sat nextdoor to China which itself is Asia's first economic powerhouse of the 21st century.

Now, with the highly uncertain world, once again, we are withnessing the migration of the Hongkongers and the Chinese to the West and to the South of the world. 

And now Singapore happens to be at the pivot point of all these massive movements of people from North Asia; people with abilities, aptitudes and assets all seeking refuge in a new stable land or a safe haven.

Ministry of Manpower (MOM) said on Monday, 14 August, that it is seeking public views on designating platform workers as a distinct category of workers, noting that creating a category distinct from other employees and the self-employed would make it easier for these workers to understand the legal protections and support schemes that they are eligible for.

MOM also said platform operators need to take “reasonably practicable measures” to ensure the safety and health of platform workers with whom they enter into contracts, and it wants to get feedback on these obligations.

💬 *What are your views on MOM’s proposal to designate platform workers as a new, distinct category of workers? How can we better protect platform workers through the various support schemes?*

Deliverymen and ride-hailing drivers who use online matching platforms such as Grab, foodpanda and Lalamove for work here could be designated as a new worker category under new measures that are being drafted by the authorities.

These measures include setting reasonable expectations for how much time is needed to fulfil a job so that workers do not need to rush, and rolling out mechanisms for the public to report unsafe driving or riding to the respective platform operators. These new measures are expected to kick in from the second half of 2024.

The new protections will be given only to platform workers who provide ride-hailing and delivery services.

📌 *Defining Platform Operators*

MOM proposes that platform operators here be defined by 3 ‘prongs’:

1️⃣ The first prong defines platform operators as those that collect data to automate the matching of customers with workers – for instance, by assigning a particular ride-hailing driver to make a trip based on his estimated time of arrival.

2️⃣ The second prong limits the scope to cover only operators that provide such chargeable matching services as a business model.

3️⃣ The third prong further defines platform operators as those that exert control over platform workers, by limiting their ability to choose their hours of work or negotiate a fee, for example.

📌 *MOM Public Consultation via REACH website*

The public consultation, which is being conducted online until Sept 4, will also gather views on how else platform operators and workers should be defined under the new laws, and who should be responsible for protecting platform workers engaged as subcontractors. Those who wish to give their views on these issues can do so on the REACH website at https://go.gov.sg/publicconsultpwbill by 6pm on Sept 4. 

The consultation exercise comes as the Government prepares to table new legislation in Parliament to implement a set of new policies that will grant platform workers employee-like levels of work injury compensation insurance and Central Provident Fund contributions.

All platform workers includes  part timers who engage in delivery services shall be licensed and regulated under the three categories:

Category of Licence:

1) Cat A for bicycle or electric bike or on foot delivery workers. Licence fees $25/yr.

2) Cat B for motorcycle delivery workers. License fees $50/yr.

3) Cat C for private car delivery workers. Licence fees $100/yr.

All categories license renewables on an annual basis with up to date insurance coverage for hospital, injuries,. third of party, disabilities, and death. 

Merit & Demerit points system?

All motorized vehicles must have a valid driver's license.

"Legislate and Legitimate"

Licensing & Regulations?

All platform workers includes  part timers who engage in delivery services shall be licensed and regulated under the three categories:

Category of Licence:

1) Cat A for bicycle or electric bike or on foot delivery workers. Licence fees $25/yr.

2) Cat B for motorcycle delivery workers. License fees $50/yr.

3) Cat C for private car delivery workers. Licence fees $100/yr.

All categories license renewables on an annual basis with up to date insurance coverage for hospitalisation, injuries, third party, disabilities, and death. 

Merit & Demerit points system?

All motorized vehicles must have valid driver's license.

Insurance packages from $100k to $750k; choose from the approved list of insurers provided by MOM.

Legitimate?

Companies that hire all platform workers must fulfill all of these requirements prior to hiring and deploying the workers for any delivery services. And submitted to MOM the details of their staff.

How about unionised under NTUC? CPF contributions from 10%-25%?

All licensed delivery workers must carry the ID which has the person name, photo, name of company, vehicle registration number, and QR code to allow customers to scan the QR code as verification of proof of delivery and proof of license.

Legislate using technologies?

Misuse of license such as lending or borrowing others ID or fake licence or tempering of the QR code equals to the violation of false ID acts. And the first offender shall compound a penalty sum of $300 and second offense to double and the third time shall be fined $1,000 and license impounded up to three years.

With the QR code scanning method, the company and the customers will ensure safer delivery and at the same time monitoring the platform staffs from not OVERLY work within a five or six days work week. It can also be a useful and accurate gauge of employees earnings thus a sustainable and transparent Income and tax regime for both the company and individuals.

Regulate & Enforce?

MOM-LTA-SPF-ACRA: the coordinating Ministries and agencies to oversee, issuance of license and enforcements of all requirements.

Afterwords:

"Wages for Workers"

Companies should incentivise the PWs and PHs starting with the basic 40 hours work week.

From 41-48 hours considered as overtime and the incentive given shall be 1.5x. 

For 49 hours onwards or super holidays and long weekends, up to 2.5x incentive.

Legislate the above rules through tripartite initiatives?

(With the legislation, it should add extra incomes for the PWs or PHs closer to $4,000/mth)

Best Scenario?

PWs or PHs work on a 40 hour work week excluding weekends or Public holidays, this is the baseline if it is legislated?

3 days x 12 hours/day = 36 hours work week.

The fourth day, hardworking, you do another 12 hours.

The fifth day is your bonus day! Your company will pay you OT at 2.5x !

All in, your monthly 5 days work week will bring to your table over $5,000! Possible?

Buildup your CPF kitty?

CPF contributions assuming fully borne by PWs or PHs or companies pay up to 10%, incentive to apply into this employer's contributions?

PWs or PHs contributions from 10-25% self contributions.

Special Tax incentives from IRAS for all platform workers at 10%?  

Projection?

The projection of growth of the PWs from the present 88,000 shall increase to over 100,000 workers by 2025? 

With over 80% of these workers are full timers and the remaining are part timers.

By means of part timers, the total work hours per week is 30 hours or less.
