On Friday 4 August, the Tripartite Committee on Workplace Fairness released their final report on 22 recommendations for the Workplace Fairness Legislation (WFL) to strengthen workplace fairness. WFL will strengthen protections against discrimination and ensure that employees and jobseekers have fair access to job opportunities. 

Minister for Manpower, Dr Tan See Leng had earlier said that “The Workplace Fairness legislation marks a significant step in Singapore employment law, and it will be scoped to achieve three wins:  preserve harmonious workplaces, better protect workers, and support business growth in Singapore." These Government will work closely with Tripartite Partners to implement the recommendations in 2024.

*💬 What are your thoughts on the proposed law against workplace discrimination? How can employers better support workplace fairness and ensure fair access to job opportunities?*

The recommendations of the Committee are guided by the following principles:

📌Introduce workplace fairness legislation to complement the Tripartite Guidelines on Fair

Employment Practices (TGFEP) and not replace it. The TGFEP remain an important part of our workplace fairness framework that set out the positive principles

 of fairness for employers.

📌Scope legislation appropriately to foster strong employer ownership and support fair and just workplace outcomes for employees.

📌 Give more assurance to workers that they can report workplace discrimination or harassment without fear of retaliation.

📌Support national objectives and permit genuine occupational needs to be considered in employment decisions.

📌 Preserve workplace harmony and maintain a non-litigious workplace culture, with mediation as the  preferred approach to resolve disputes. 

📌Ensure that discriminatory employers face appropriate enforcement action, and provide redress to individuals who have been discriminated against. 

Some of the key recommendations  by the Committee includes prohibiting workplace discrimination in respect of the following characteristics: (i) nationality, (ii) age, (iii) sex, marital status, pregnancy status, caregiving responsibilities, (iv) race, religion, language, (v) disability, mental health conditions, requiring employers to put in place proper grievance handling processes and call for appropriate redress for victims of workplace discrimination covered by the new legislation and appropriate enforcement action against errant employers.

07/08/2023, 10:45 am - +Kenneth Lee WM: MOM has good intentions.  It's very good.  But it's going to be hard to implement and I don't have any good suggestions how to do it.  It's very easy for companies to justify and change the JD/KPI to fit the type of candidate they want or to kick someone out.  I hope MOM can figure it out.

Discrimination and/or Favoritism?

"The larger an entirety is...the higher you climb the corporate ladder, the bigger the picture of the strategic map you see and the key focus is to be able to zoom into each level of the processus, the policies and the people; all in, these leaders must have the detailed know how, the stamina and on-sight to connect all people at each level and importantly for the top leadership to be able to connect to ALL people or you will lose touch and the game of "snake and ladder (internal conflicts and politics)" will befall upon you regardless if you are the staff or the boss; all are colleagues in-fighting!"

Initiation?

An attempt of addressing the workplace discrimination practices, it is a good starting point to resolve this illness at work, a first happiness for the working order !

However, we are not only dealing with a carefully planned code of conduct of what is not acceptable and what is clearly wrong doing whether is a peer to peer or manager to subordinate or colleague to colleague from different departments.

The core of the pain is hidden in the inner part of a human being. what is motivation and what is intention?

the word motif derives from the self and through a longer timeline, beliefs are generated and more than a few people will believe certain principles or concepts are acceptable or wrong or correct!

For thousands of years, human are living in this world that is full of subjects and objects that created different opinions and comments on all outcomes. Even history can be subjective and at times objective too! 

So what to belief and what is wrong? As for portion of correctness, its almost certain that it will be fully embraced by billions, isnt it easier to sell the belief of righteousness over viciousness?

Often in our daily lives, we encounter these three variables of three existential that is options, risks and hopes. 

In layperson context, the closest match is perhaps persist opinions. This paradigm of opinion is often expressed in writings or verbally expressed across all known media of comments. This big , stub-born and unchanged is scarecy and not secrecy!

Don't waste your time to convince or to convert the cognitive kinds, this 'scared' belief is the bedrock of non-negotiable from whatever opinions or comments.

1. The principles laid out by MOM against workplace discrimination looks sound, fair and will provide a safeguard against discrimination in the workplace.


2. But genuine, effective implementation by Employers - is the key to success.


3. Hence, I will like to suggest "Annual Audit" by trusted agents commission by MOM to audit companies is the key to ensure discrimination are not being covertly or overtly carried out by the managers, superviors and bossess at all levels.


4. Similar to annual audit of books and finances, annual audits of workplace discrimination is a deterrence, to show that MOM is serious in cleaning up the act of discrimination at the workplace.


5. Companies that have been "whistle-blowed" should be paid particular attention that CEO, senior management, managers and superviors at all levels do not carry discriminatory practices against their staff.

- All suspicious cases should be look into, especially those retrenched, resign, demoted cases, to identify whether discrimination have been carried out.

Past performance records of the staff should be audited for all these staff - as it will revealed why good performers are retrenched, demoted or force to resign.

- Hiring practices, hiring outcomes should also be studied to determine if discrimination have been carried out.

- Whistle-blowing cases should be look into and checked against.


6. Only through such systematic process of annual audit against workplace discrimination will ensure all the prinicples laid out by MOM can be achieved.

Auditors should also pick and interview staff within the companies anonymously - to determine whether discrimination have been carried out especially those suspicious cases such as mature workers, appraisal records (past versus present performance) - and all interview records keep anonymous - but allow auditors to make conclusion whether indeed discrimination have been carried out.


8. Auditors should also have accessed to records of staff that have been retrenched or force to resign - for an anonymous interview - to establish whether ex-staff are discriminated against - so that conclusion can be made whether the companies have indeed carried out workplace discriminatory practices.

I am very sure, many such cases can be uncovered.

Staff pick for the interview should not be make known to the companies.

This will allow staff to present their cases or experiences honestly without fear and protect the staff from repercussion by the supervisor or the company.

1. In private sectors, it varies very widely how the bosses and companies treat their staff.


2. I have come across bosses that treat their staff like the family members.

Ensure the staff can officially retire peacefully, ensure their families are well and invite their staff and family members to annual events.


3. I also have come across some bosses and companies that treat staff like dirt, playing office politics, making the workplace toxic - see the very ugly side of human nature. <This message was edited>

07/08/2023, 3:08 pm - +KL: I agree , some company every time do the same till covid 2021, they miss calculated . As no foreigner EP can be hire and they already issue some notice. To old hirer . Intially some old staff already issue verbal self resign  . So they are to find internal transfer themself or outside . But Suddenly 2 younger staff resign and another 2 younger staff request to transfer out cos of good job market so the boss keep quiet , nothing happen before . The another team also face same issue suddenly approach the 2 old staff if they looking for job . Intially they was given cold shoulder . lucky the the few old staff found a better job and together with the 4 live happily after . Of course the few old staff should have got ard a 7-12 month retrenchment benefit did not get it sia . <This message was edited>

If bosses understand that staff whether young or old are there to help them to be profitable, contribute to the company, then bosses should show gratitude and take care of the staff whether old or young - and not discard them when they grow old.

This will win the respect and loyalty of the staff.

If bosses treat staff well, staff will work hard for the bosses.

This is human nature.

Boss and staff relationship should not be a transaction but a relation.

Hence this has become my philosophy as a supervisor and manager.

1. My staff is my family members and I ensure I take care of their well beings, their benefits, coach them and counsel them - and ensure they contribute and do their best for the work.


2. I build relationship, and I don't view the boss-staff relationship as transactional.


3. In so doing, staff will be motivated, give off their best in their work and stay loyal to the company.


4. I don't discard them when they grow old, I will ensure they go for skill training to stay relevant, competent and be a responsible staff.


5. When their performance slip, I will find out the root cause, provide coaching and counseling until they lift themselves up and perform at a competent level.

I don't kick them out or rate them poorly - always emphasizing how they can improve and perform at a competent level.


6. This is my philosophy as a supervisor and a manger - build relation not transaction with my staff.


7. If this can be done, there will be no cases or issues of workplace discrimination.

On Friday 4 August, the Tripartite Committee on Workplace Fairness released their final report on 22 recommendations for the Workplace Fairness Legislation (WFL) to strengthen workplace fairness. WFL will strengthen protections against discrimination and ensure that employees and jobseekers have fair access to job opportunities. 

Minister for Manpower, Dr Tan See Leng had earlier said that “The Workplace Fairness legislation marks a significant step in Singapore employment law, and it will be scoped to achieve three wins:  preserve harmonious workplaces, better protect workers, and support business growth in Singapore." These Government will work closely with Tripartite Partners to implement the recommendations in 2024.

The recommendations of the Committee are guided by the following principles:

📌Introduce workplace fairness legislation to complement the Tripartite Guidelines on Fair

In a project especially those that have very tight deadlines, all stakeholders must be in office to coordinate solutions and resolve issues.

No way people WFH can achieve this.

Hybrid WFH and office makes more sense - when people need quiet time to write report, or coin strategic directions or do budget etc that requires less disruption - then WFH make sense.

But when come to system integration, project coordination, or times when need to work across division etc - it is more productive to be all in office.

Zoom meeting don't work and don't make sense.
