On Monday (22 Jan), Law and Home Affairs Minister K Shanmugam clarified that while a proposed harsher sentencing option could mean that some dangerous offenders who committed serious crimes could be detained indefinitely, it was also likely that some would be detained for a shorter period.

Minister K Shanmugam made these remarks to clarify some misunderstandings and aspects of a new Criminal Procedure (Miscellaneous Amendments) Bill that was recently introduced in parliament earlier this month.

*💬 What are your views on the proposed harsher sentencing option for high-risk offenders? What more can we do to ensure public safety is prioritised?*

The proposed framework empowers the courts to apply a Sentence for Enhanced Public Protection (SEPP) on dangerous offenders, specifying an imprisonment period spanning from five to 20 years.

Addressing apprehensions, Mr. Shanmugam clarified concerns related to the possibility of offenders sentenced to an SEPP being detained for life or an extended duration beyond the current norms.

Mr. Shanmugam highlighted that those who fail to undergo rehabilitation and consistently pose a significant risk post their minimum sentences may face extended detention. Additionally, he acknowledged the possibility of some offenders being subjected to shorter detention periods.

Nothing profound, the proposed stricter measures perhaps is to ensure the overall public safety and at the same consideration all questionable spectrum of mental disorders may continue to haunt a person for a longer period of time or in cases over a lifetime of mental instability even with medical interventions. 

There are Psychiatric evidences to substantiate when mentally unstable patients encountering past experiences (unconscious) in present moment (un-conscious) may trigger them to commit illogical acts upon other innocence strangers at random or in a sequential momentum triggering undesirable social actions, once again, similar to previous convicted wrongdoings."

I understand the good intent of SEPP but I'm concerned over the final decision of release rest upon the Minster of the day.

Does that mean we are mixing government powers and judicial powers?

I think there is a valid point for the bill.

Because hardcore criminals after serving their sentence - do continue to commit crime because they have not repented.

Thus they do post a threat to the society.

Hence additional measures will need to protect society from such hardcore criminals.

But of course, there is a need to ensure the additional measures are appropriate, not punitive or subject to abuse - because true enough, good government is not always a given in a democracy as populism can throw in a fluke government.

Road accidents that caused severe damages or death. Part of the preliminary Police investigations is to dig into Both victim and driver mental health to disprove any foul play or existing mental disorders or intentional suicidal behavior. Are there past and or present traces of prescribed psychotic drugs, drugs overdose or drugs abused? All of these knowns and unknowns will form the  bulk of legal challenges to the defense and the prosecution....

1. Looking at this Bill objectively, I think there is valid justification to :-

a. Ensure hardcore, recalcitrant and refusal to repent criminals - are kept out of the Society - as they will re-commit crimes and cause harm to the population - even though they may have finished serving their sentence.

b. Judge will be stressed out to meted out the maximum sentence - even though the crime may not merit it - if the Judge feel that the accused will re-offend after completing his/her sentence.

Sometimes, even the maximum sentence will not keep the offenders from re-offending again - if the offenders have not repented and refrain from re-committing crime.

c. Hence, I feel that most people will support the need to implement additional measures - rather than just relying on court sentence to deter hardcore recalcitrant and non-repentance criminals.

I feel that there are not much dispute or disagreement on this point.

2. Now is how to implement additional measures fairly to ensure hardcore criminals are keep out of the Society from causing harm, but at the same time :-

a. Ensure the additional measures are not being abused

b. Administer fairly

c. And an escape switch be allowed, if hardcore criminals have indeed repented and longer custody will not be necessary.

d. Another dimension is being raised - should Government and Justice functions be segregated - in administering criminal justice?

Let us examine this dimension in details later on.

*Should Government functions be segregated from Justice functions - in administering criminal justice?*

1. The issue being, Government is a lawmaker that make laws, debate in Parliament, get the law approved.

And Courts will judge based on the approved laws - in administering justice.

Hence the segregation of functions is clear and transparent - no conflict of interest.

And no one is above the law.

This scenario is particularly important as it introduce "check and balance" - whereby Government check on the Justice function (by amending laws to ensure Justice can carry out its job competently and objectively).

At the same time, Justice and check the Government to ensure abuse cannot take place and no one is above the law.

And particular applicable - if populist fluke incompetent government win the election in a democratic election.

2. On the other hand, if a good and competent Government is helming the Governance, then a caring and competent Minister who has the last say that encompass this new Bill is not an issue - because the Government job is to protect the population and the Society.

3. The concern raise by my close friend - is due to many examples that have recently arises globally --- too sensitive to raise here.

But indeed a rogue government - could have abused the additional measures - and keep people out of circulation.

4. So throwing another mechanism into discussion :-

- how about having an advisory panel comprising of professionals of the right calibre to advise the court?

5. There are pros and cons to each approach:-

a. Minister have the final say - to extend or shorten the criminals - based on experts advise - if indeed the hardcore criminals have repented or not.

- Pro :- A good, competent and caring Minister will be very efficient and effective - in safeguarding the population and Society, while ensuring the offenders right are not abused if the offenders indeed have repented and can be re-integrated into the Society.

- Con :- A bad Minister could abuse it - by keeping good people but non-supporters of Government out of the Society.

b. An independent advisory professional panel.

- Pro - Justice independent from Government. Professional advisory panel more objective and less likely to subject to abuse - if the independent panel is objectively selected.

- Con - less efficient and more time consuming to assemble a team of independent professionals. Still can be abused if selected by a bad government to do its biding.

Even if this independent advisory professional panel is decided by Court and not the Government - there are still cons to it, for example:-

- A bad government can retire the Judges and insert Judges that do its biding.

- Court may not have the expertise to look for and appoint competent and independent professional panel - and will have to rely on Government that have the resources and knowledge to do so.

6. Hence I stay neutral in either approach - that is Minister have final say or Independent Professional Panel --- as both approach have its pros and cons -- and both rely on a Good and Competent Government of the Day.

Hence electing a Good and Competent Governmen is paramount come the General Election.

Else no matter what mechanism put in to do the "Check and Balance" - a bad government can dismantle many things - and put the Country in a very bad state.

It all depends on the Wisdom of the Voters - to vote in a Good and Dependable Government - not a populist one that promise everything under the sun - but will sink the Country in near, middle or long term.

This is my "Honest Assessment" and also my "Close Friend Assessment".

"Sanity and Proofing Beyond All Doubts"

Nothing profound, the proposed stricter measures perhaps is to ensure the overall public safety and at the same consideration all questionable spectrum of mental disorders may continue to haunt a person for a longer period of time or in cases over a lifetime of mental instability even with medical interventions. 

There are Psychiatric evidences to substantiate when mentally unstable patients encountering past experiences (unconscious) in present moment (un-conscious) may trigger them to commit illogical acts (fantasy vs reality) upon other innocence strangers at random or in a sequential momentum triggering undesirable social actions, once again, similar to previous convictions."

Back to the Future?

In 1919 Karl Jung famously wrote a paper entitled "On the Problem of Psychogenesis in Mental Disease" and twenty years later followed by the second paper "On the Psychogenesis of Schizophrenia". The two papers combined in explaining the unconscious mental activity and the personal and collective unconscious of mental patients. On Thursday (25 Jan), Minister of State (MOS) for Home Affairs Muhammad Faishal Ibrahim emphasised that it is important for society to work together to tackle the feelings of hatred that people may have for those who are different. 

MOS Faishal made these comments in response to questions about the case involving a 16-year-old self-radicalised Singaporean, who had identified himself as a white supremacist and was given a restriction order under the Internal Security Act.

💬 *What are your views on the case of the radicalised Singaporean? What more can we do to prevent self radicalisation and maintain racial and religious harmony in Singapore?*

MOS Faishal said that Singapore society is still exposed to outside developments, through the Internet or social media. In the case of the 16-year-old, the Internal Security Department (ISD) said that the youth had developed an intense hatred of communities targeted by far-right extremists after chancing upon videos by foreign far-right political commentator and white supremacist Paul Nicholas Miller. He was also exposed to violent extremist material online.

“What’s important is how we can work together with society, families, parents to build a positive life, a compassionate life where we respect one another and distance ourselves from extremist aspects that can affect not just the lives of others but also their own lives,” said MOS Faishal.

The ISD also clarified that while under the restriction order, the youth will have to undergo a rehabilitation programme aimed at countering the violent extremist ideologies he had absorbed online. ISD said it will help him learn that his racial supremacist views are incompatible with Singapore’s multiracial and multi-religious society.

1. Have the opportunity to observe the rehabilitation process of inmates, boy's home and girl's home.

2. Some come from broken homes, abusive families, some take drugs, some join gangs, some commit crimes, some fight.

3. But those i observe are determine to get themselves rehabilitated - as I observe some are hardworking, polite, respect the authority, and they carried out their tasks well assigned by the Prison officers.

Some even study hard for their courses they take.

I was quite impressed by the SCORE who formulate many courses for the inmates that genuinely want the inmates to acquire skills and knowledge - so that they can get rehabilitated and become a useful members of the society.

4. I also was told that inmates upon released are able to gain employment for enterprises that work with SCORE to place them into jobs.

Many are able to find jobs and can sustain their livelihood and their families members - and prevent them from falling back into crimes.

5. It is a consolation to realise that even inmates can be rehabilitated under the "Yellow Ribbon" - and inmates do want to change for the better.

I can see and feel the inmates eagerness to change for the better.

I am not sure, if every inmates can be reformed, but at least those I come into contact with display their eagerness not to commit offences again.

Hence, I feel that 人之初，性本善。

(Human origin is Kind) is a sound concept.

For younger children, parental guidance / review on online content which they were exposed to is very important. 

That online material may not be taken as truth and facts.

Search engines will keep feeding us with content which we read, hence trapping in our own echo chamber.

If you find yourself believing something try to Google the opposite eg if this world is about hatred, then google about loving acts of kindness.

When my child was young, he told me that Ahmad Mattar (a former minister) was a terrorist. 

I was initially confused by what he said. 

Then I understood that his teacher asked the class to research about pioneer leaders. 

I had to go thru the search history and have to correct him.

Human is a Social Animal?

Your peers or your close friends may have different views on different matters and generally the group will tend to agree on similar ideas, views, and thoughts on most matters of concern from simple stuffs to serious matters of life and death.

You see and you belief to a superficial extend only if you pursue further to find the truth of right and wrong. Just how many people would be Curious to delve further on any matters unless it's really interesting or it's concerning to them or someone gave you new perspectives of things which otherwise you simply don't care!

In today's fast information flow and overflowing, more often, opinions and comments can be contagious and dangerous at that heated moments of emotion and feeling flashing across to the social media from IG, TikTok to X which may escalate into bigger mess of mixed feelings of a group or big part of a society creating" this and that and here and everywhere" all seems to look similar expressions and this is a danger zone of mind changing and not mindsetting. That's the beginning of mining into the human minds and new habits will be formed or changed. And AI tools will fabricate things into believable objective of following amongst youngsters and older adults.  It's a choice for any internet users to be self vigilant to determine if what they read or saw are facts and information is reliable and not misinforming or disinforming  the public. 

The misused of LLM or large language models on the future of information warfare to the actual implementation of a real hot war! Its too early to fore tell if LLM will benefit society than more harm to the world of information technology.

The frequency and intensity of engaging people is one way to win the mind and the heart of individuals. It is always a positive conditioning of the mind and it's never a negative one. People tend to belief that they are not easily influenced by others and fact is  this is a human cognitive error. It's not hard to control thoughts and winning trusts and hearts of individuals. Its about experienced, experiencing and experimenting over time will form a person mind , beliefs and behaviors. If the mind is set, perhaps there will be no room for changes?

The Listening Post?

One powerful method of building Trust is to listen to your fellow beings. It not only effective in mining the mund or slowing down the person who is identified as potential threats, unique sense, and the mind has changed against socal norms and rights. By listening to individual, you will find out the deeper thoughts and the roots cause of such mind alteration process that has happened over a longer period of time. 

In the early stage of probing and listening, you will gain insights into this individual past and present moods, events and setbacks. The key is to look for significant events that caused setbacks and the more severeit was or failure happened, the higher the chances to change the mind of the individual. Either it can change the mind for good or it can changed the mind for bad intentions. 

No radicals will use harsh or blunt words, softer words of positive conditioning will allow many moments of unchecked (careless) minds to accept the process of mind changing in an unchallenged environment and thorough communication.

How to control minds?

Patience pays! Attitude, Personality and Character are values and judgments of individual formative years of education, it means from age 6 to 16-18 years.

Foremost, identifying individual behaviors in determining if this person is an introvert or an extrovert.

Introvert tends to be deep thinkers and extrovert don't think beyond now. Each type has it weaknesses and it is through deeper conversation or interaction, we will be able to form a detailed psycho mapping of individuals.  

What is success and what is failure for a 6 year old, 12 years old and 16 years old?

All of these junctions of one's early childhood will mould and shape individuals from teenager to young adult. Attitude, Personality and Character are formed...

The more failures one experienced or experiencing now, the higher one lost Hope for tomorrow! It's like living today and don't know about tomorrow?

Fact is today is the beginning of tomorrow to come? Arguably, spiritually speaking it is NOW that matters than tomorrow?

If you believe that humankind is an adaptive and evolving species so does the brain that is the controlling centre of a Human's mind to act, to react or to proact.

Applying all the above to good use or for bad purposes, it's the same methods and the difference is the intent and the outcome.
